SMARTCV POPI ACT AGREEMENT
(Protection of Personal Information Act, 4 of 2013)
1. Introduction
SMARTCV (“the Company”) is committed to ensuring the protection of personal information in compliance with the Protection of Personal Information Act, 2013 (“POPIA”). This agreement outlines the principles and practices that the Company adheres to regarding the collection, storage, and processing of personal information.
2. Definitions
- Data Subject: Any person whose personal information is being collected, stored, or processed by the Company.
- Personal Information: Information relating to an identifiable, living, natural person and where it is applicable, an identifiable, existing juristic person. This includes but is not limited to names, identification numbers, contact details, demographic information, financial information, etc.
- Responsible Party: SMARTCV, the entity responsible for processing the personal information of the data subject.
- Processing: Any operation or activity concerning personal information, including collection, receipt, recording, organization, retrieval, or dissemination.
3. Purpose of Processing
SMARTCV collects and processes personal information to provide services related to career guidance, CV management, and recruitment. The information is processed for the following purposes:
- To assist users in building and optimizing their CVs for job applications.
- To provide career advice and updates.
- To connect job seekers with potential employers.
- To comply with legal requirements.
4. Collection of Information
Personal information will be collected directly from the data subject unless otherwise permitted by law. The types of information collected include:
- Personal identification details (name, surname, ID number, passport number).
- Contact details (email address, phone number, physical address).
- Employment and education history.
- Skills and qualifications.
5. Consent
By using SMARTCV’s services and providing personal information, the data subject consents to the collection, use, and processing of their personal information as described in this agreement. The data subject has the right to withdraw their consent at any time by contacting SMARTCV.
6. Rights of the Data Subject
The data subject has the following rights under POPIA:
- Access: To request access to their personal information held by the Company.
- Correction: To request the correction or deletion of inaccurate, irrelevant, or outdated information.
- Objection: To object to the processing of their personal information in certain circumstances.
- Erasure: To request the deletion of personal information that is no longer necessary for the purposes for which it was collected.
- Data Portability: To request a copy of their personal information in a readable format.
7. Disclosure of Information
SMARTCV will not disclose personal information to third parties without the data subject’s consent, except where required by law, or in the course of rendering its services to the data subject (e.g., sharing information with potential employers or recruitment agencies).
8. Data Security
The Company takes reasonable and appropriate measures to secure personal information against unauthorized access, loss, destruction, or damage. These measures include:
- Secure online platforms with encryption.
- Password-protected databases.
- Regular system audits and updates.
9. Data Retention
Personal information will be retained for as long as it is required for the purposes for which it was collected or as required by law. Once the information is no longer needed, it will be securely destroyed or anonymized.
10. Changes to the Agreement
SMARTCV reserves the right to update this POPIA agreement as necessary to comply with changes in the law or internal policies. The latest version of this agreement will be available on the SMARTCV website.
